Brown v. United States, 256 U.S. 335, is a US Supreme Court decision about a self-defense shooting by a citizen of an assailant armed with a knife – from 1921. I’ll get to an older self-defense shooting in the near future.
The key part of the Court’s ruling reads: “Detached reflection cannot be demanded in the presence of an uplifted knife.”
While that line shouldn’t leave any questions in the reader’s mind, the Court continued on, adding:
“Therefore, in this Court at least, it is not a condition of immunity that one in that situation should pause to consider whether a reasonable man might not think it possible to fly with safety or to disable his assailant, rather than to kill him.”
One hundred years ago the Supreme Court knew trying to use deadly force in a less than lethal way was completely unacceptable. Please consider that last part when a politician bloviates - again.
